These Terms of Use ("Terms") are an agreement between you and KineticReaction ("we," "us," or "our") and govern your use of our iOS apps — Gun Timer and Army Body Builder — and our website and store at kineticreaction.com (together, the "Services"). By downloading, accessing, or using the Services, you agree to these Terms. If you do not agree, do not use the Services.
Shot detection and timing depend on your device's microphone and environment and may be inaccurate or incomplete; do not use the app's output where precise or certified timing is required. You assume all risk associated with firearms training. We are not liable for any injury, death, or property damage arising from your use of firearms or the app.
Scoring tables, calorie and macro estimates, and fitness-test calculations in the app are approximations provided for training reference only. They are not official scoring and may differ from the current, authoritative standards published by any military branch. Always confirm requirements with your unit, recruiter, or the official source.
KineticReaction and its apps are independent products. They are not affiliated with, endorsed, sponsored by, or officially connected to the U.S. Army, U.S. Department of Defense, or any branch or agency of any government. References to fitness tests and branches are for identification and training reference only.
Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the apps on Apple devices you own or control, for your own non-commercial training use. You may not copy, modify, reverse-engineer, resell, or redistribute the apps except as permitted by law. Apps are licensed, not sold. Your use of apps obtained through the App Store is also subject to Apple's applicable terms (including the Licensed Application End User License Agreement).
You agree to use the Services lawfully and not to misuse them, interfere with their operation, attempt to gain unauthorized access, or use them in any way that could harm others or violate applicable laws.
Gun Timer and Army Body Builder are offered as auto-renewing subscriptions through the Apple App Store: a 7-day free trial, then $4.99 per month each (the two apps are billed separately). Payment is charged to your Apple ID at confirmation of purchase. The subscription renews automatically each month unless cancelled at least 24 hours before the end of the current period; your account is charged for renewal within 24 hours before the period ends. You can manage or cancel a subscription, and turn off auto-renewal, in your Apple ID account settings. Any unused portion of a free trial is forfeited if you purchase a subscription. Prices may vary by region and are subject to change; billing, refunds, and cancellations are handled by Apple under the terms of your App Store account.
Apparel and accessories sold on our site are made to order and fulfilled by our print-and-ship partner. Prices are shown at checkout and may exclude taxes and shipping, which are calculated at checkout. Payment is processed securely by Stripe. Because items are produced on demand, order changes or cancellations may not be possible once production has started.
If your item arrives damaged, defective, or incorrect, contact us within 30 days of delivery at hello@kineticreaction.com and we will arrange a replacement or refund. As print-on-demand items are made for you, we generally cannot accept returns for buyer's remorse or sizing unless the item is flawed; please check sizing before ordering.
The Services and all content we provide — including the KineticReaction name, logos, app designs, apparel designs, text, and graphics — are owned by us or our licensors and protected by intellectual-property laws. You may not use our marks or designs without our prior written permission.
The Services are provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or accurate.
To the fullest extent permitted by law, KineticReaction and its owners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or for any personal injury or property damage, arising out of or related to your use of the Services. To the extent liability cannot be excluded, our total liability is limited to the amount you paid us (if any) for the product or service giving rise to the claim. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.
We may modify or discontinue any part of the Services at any time. We may also update these Terms; when we do, we'll revise the "Last updated" date above, and your continued use after changes take effect constitutes acceptance.
These Terms are governed by the laws of the United States and the state in which KineticReaction operates, without regard to conflict-of-laws rules. Any dispute will be subject to the courts located there, unless applicable law requires otherwise.
